The 1970s and 1980s brought remarkable changes for the Untied States. The Cold War between the US and its allies versus the Soviet Union and its allies/clients was still the dominant international issue. China was also going to start emerging as a major world power. Nixon was dealing with Vietnam and then Watergate—one of the pivotal scandals of modern history. Reagan would bring a new national spirit, and he would tackle economic problems by deregulation and moderating taxes—and he would be dealing with a very new type of Soviet leadership.
Discuss lessons in leadership with the examples of President Nixon and President Reagan:
Choose and discuss (in a full paragraph or two) one of the following two topics related to the 1960s and 1970s, especially to the terms of Presidents Nixon and Reagan.

Question 1. Potential Constitutional Issues at Trial: There are so many pre-trial hurdles that must be carefully guarded. The first Constitutional issue to be wary of is the presumption of innocence until proven guilty by a jury of his peers (Coffin v. United States, 156 U.S. 432 (1895)). This is also embedded in the due process clause of the Fourteenth Amendment. The second concern is whether the police complied with the Fourth Amendment governing probable cause and evidence gathering, the Fifth Amendment on being appropriately Mirandized, and the Sixth Amendment of the right to assistance of counsel and impartial jury.
Question 2. What I Can Do as a Judge to Avoid Appellate Reversal: On the issue of presumption of innocence, I would ascertain that the defendant is mentally competent to stand trial. That the defendant's case is not fraught with the insanity defense. On the due process clause, I would ascertain that all the evidence collected is legitimate and that any illegally obtained evidence is excluded from being introduced during the trial. I would ensure that an impartial jury is assembled and that the defendant, through his counsel, can air out all his defense strategy. Above all, I would impartially instruct the jury according to the law.

Officer Martinez takes a statement from the security guard and views the in-store camera film of the shoplifting incident. Officer Martinez places the suspect under arrest, reads the suspect the Miranda warnings, and asks the suspect if he would like to make a statement. The suspect replies, "No, I would like a lawyer". The suspect is then transported to the local jail and booked. Six hours later, the suspect is interviewed by a detective who again reads him the Miranda warning. The detective then asks the suspect if he would like to talk. The suspect says, "Yes." He eventually confesses to the crime.

1. Identify and discuss the constitutional amendments that would relate to this situation.
2. Discuss how the Edwards rule is related to this situation.
3. In your opinion, determine if the suspect's confession to the detective is admissible. Support your opinion with specific case law or contemporary cases.
